The fine print

Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Havoc Win ("havocwin.com", "we", "us" or "our") and govern your access to and use of havocwin.com, its subdomains, applications and services (the "Platform"). They incorporate by reference our Privacy Policy, Responsible Gambling Policy, AML/CTF Policy, Bonus Terms and all game rules. By registering, accessing or using the Platform you accept these Terms in full. If you do not accept them, do not use the Platform.

1. Licensing

Havoc Win is licensed and regulated by the Government of the Autonomous Island of Anjouan, Union of the Comoros under the Computer Gaming Licensing Act 007 of 2005, licence number ---, and is registered at St Lucia. The licence authorises the operation of online games of chance and skill and confers no right on you.

2. Definitions

  • "Account" is your personal account on the Platform. "Balance" is the cryptocurrency funds credited to it.
  • "Bet" or "Wager" is any stake placed on any game or product. "Winnings" are amounts credited as a result of a Bet.
  • "Restricted Territory" is any jurisdiction listed in Section 4 or otherwise notified by us. "KYC" is our identity and source-of-funds verification.
  • "Havoc Points" are the non-monetary loyalty points in Section 12. "Provably Fair" is the verification method in Section 10.

3. Eligibility

By using the Platform you represent and warrant, on a continuing basis, that: (a) you are at least 18 years old, or the age of majority where you live if higher, and have full legal capacity; (b) you are not in, resident in, or a national of a Restricted Territory; (c) you act solely for your own personal recreation and not on behalf of any third party; (d) the funds you use are lawfully yours and not derived from any unlawful activity; and (e) your use breaches no law applicable to you.

It is your sole responsibility to confirm that online gambling is lawful for you. We make no representation that the Platform is lawful in your location. Underage gambling is prohibited: we may require proof of age at any time and will void all Bets, forfeit all Winnings and close any Account found to belong to an underage person.

4. Restricted Territories

The Platform may not be accessed or used from, or by anyone resident or domiciled in, a Restricted Territory. These currently include, without limitation: the United States and its territories, the United Kingdom, France, Germany, the Netherlands, Spain, Australia, Austria, the Union of the Comoros (including Anjouan), any comprehensively sanctioned jurisdiction, and any country identified by the Financial Action Task Force (FATF) as a High-Risk Jurisdiction subject to a Call for Action (currently North Korea, Iran and Myanmar).

We may amend this list at any time. Using a VPN, proxy or any means to conceal or misrepresent your location, or otherwise circumventing our controls, is a material breach and entitles us to close your Account and void and forfeit your Balance and Winnings in full.

5. Your Account

You may hold only one Account and must register accurate, complete information and keep it current. You are solely responsible for your credentials and for all activity under your Account, and must notify us immediately of any suspected unauthorised use. We are not liable for any loss arising from unauthorised use of your Account except to the extent caused by our own failure to take reasonable care.

We may refuse to open, and may suspend, restrict or close, any Account at our sole and absolute discretion, with or without notice and without any obligation to give reasons, subject only to the release of any Balance legitimately and indisputably won. Multiple accounts, and accounts opened with false, another person's, or duplicated information, may be closed and their balances and Winnings forfeited.

6. Verification, KYC and Source of Funds

We may, at any time and as a condition of continued use, of any deposit, or of any withdrawal, require you to verify your identity, age, location, payment method, wallet ownership and source of funds or wealth, and to provide any document we consider necessary. You authorise us to make, directly or through third parties, any enquiry we consider necessary to verify this information.

Until verification is completed to our satisfaction we may restrict deposits, wagering and withdrawals and may freeze your Balance. If you fail to provide requested information, or we cannot verify it, or we suspect it is false, we may suspend or close your Account and withhold or forfeit funds in accordance with these Terms and applicable law.

7. Deposits

The Platform accepts supported cryptocurrencies only, deposited from a wallet you own and control; third-party deposits are prohibited. Deposits credit after the required network confirmations. You are solely responsible for sending the correct asset to the correct address on the correct network; funds sent incorrectly may be unrecoverable and are at your own risk.

We hold your Balance solely to enable play, pay no interest, and provide no banking, custody, investment or fiduciary service. We are not responsible for any change in the value of your Balance due to cryptocurrency price movement.

8. Bets, Games and Settlement

When you place a Bet you accept the rules of the relevant game as published. A confirmed Bet is final and cannot be changed, cancelled or withdrawn by you. Bets are settled according to the game rules and the outcome determined by the Platform. It is your responsibility to understand each game, including its rules, odds, house edge and return to player, before playing.

Our records and our determinations are final and binding in all matters relating to your Account, your Bets and your use of the Platform, save in the case of manifest error. We may refuse, limit or void any Bet at our discretion, including any Bet that breaches these Terms or is affected by an error or malfunction.

9. Errors and Malfunctions

We are not liable for any error or malfunction affecting a game, market, Bet, odds, payout, Balance or transaction. Where one occurs we may void the affected Bet or transaction and correct any Balance. Malfunction voids all pays and plays.

If your Balance or any payout reflects an amount not correctly due to you (including through system error, mispricing, duplication or any defect), the correct amount applies, no such amount is payable, and we may reclaim, set off or recover any overpayment by any lawful means. You must promptly notify us of, and must not exploit, any error, bug or defect you become aware of.

10. Withdrawals, Limits and Payouts

You may request withdrawal of your available, legitimately won Balance to a wallet you own and control, subject to these Terms, completion of KYC, and applicable limits. We may set, vary and enforce minimum and maximum withdrawal amounts and maximum payout limits per Bet, game, feature, period or Account, and may pay any large Winnings in reasonable instalments.

We may review, hold, delay or decline any withdrawal, and may withhold, freeze or suspend any funds, for as long as we consider necessary to complete any verification or investigation or to comply with our obligations, without liability for the delay or for any change in cryptocurrency value during it. We may deduct network fees, and may set off against your Balance any amount you owe us for any reason. Any funds or Winnings arising from or connected to a breach of these Terms, prohibited conduct, bonus abuse, fraud, or an error or malfunction, are void and may be withheld, forfeited or reclaimed by us in full.

11. Provably Fair

Many games are Provably Fair: each outcome is cryptographically committed before you Bet, using a hashed server seed with your client seed and a nonce, so results cannot be altered after the fact and you can verify any outcome using the tools provided. Verification confirms a result was not tampered with; it does not change the published house edge or odds, and its use is optional and at your own initiative.

12. Bonuses and Promotions

Bonuses, rewards, rakeback, races, reloads and other promotions are offered entirely at our discretion and are subject to their own published terms, which prevail over these Terms for that promotion and may include wagering requirements, eligibility, time limits and maximum-bet and maximum-conversion limits. We may add, amend, suspend or withdraw any promotion at any time.

Bonuses are for genuine recreational play. Any conduct we reasonably consider bonus abuse, including multiple accounts, coordinated or hedged low-risk play designed to extract value, or exploiting a promotion contrary to its spirit, entitles us to void the bonus and all related Winnings and to close the Account.

13. Havoc Points and Loyalty

Havoc Points are a non-monetary loyalty feature. They have no cash value; confer no ownership of, or entitlement to, any current or future asset; and are not transferable, redeemable or exchangeable for money. Any future benefit associated with them, including any token distribution or airdrop, is entirely at our discretion, is not promised or guaranteed, and may be changed, delayed or cancelled at any time. Earning rates are published and may change. Any abuse of the programme forfeits Havoc Points and may result in Account closure. Nothing regarding Havoc Points or any token is an offer, solicitation, investment advice, or a security.

14. Prohibited Conduct

You must not, and must not attempt to:

  • use any bot, AI, script, automation or third-party software to interact with the Platform or place Bets;
  • collude, or use any syndicate, pool or arrangement to gain an unfair advantage;
  • exploit any bug, error, loophole or defect, or fail to report one;
  • engage in arbitrage, advantage play or low-risk/hedged betting aimed primarily at extracting value from bonuses or the house rather than genuine play;
  • open or operate more than one Account, or register with false, misleading or another person's information;
  • use the Platform for any unlawful purpose, including money laundering, terrorist financing, fraud or funding illegal activity;
  • interfere with, compromise, reverse engineer or gain unauthorised access to the Platform, its systems or any Account.

If we reasonably suspect any of the above we may, at our sole and absolute discretion, suspend or close your Account, void affected Bets, withhold and forfeit balances and Winnings, and report the matter to any relevant authority. A chargeback or payment reversal is a material breach entitling us to close your Account, forfeit your Balance and Winnings, and recover the amount and our costs.

15. AML, CTF and Sanctions

We maintain an AML/CTF programme in line with our licence and applicable law. We monitor activity, apply customer and enhanced due diligence, and screen against sanctions lists. We may request source-of-funds or source-of-wealth information, delay, refuse or reverse any transaction, freeze a Balance, close an Account, and report suspicious activity to the authorities, in each case without notice where the law so requires. You agree to cooperate fully.

16. Responsible Gambling

Gambling is entertainment, not income, and can be addictive. You can set loss limits, session reminders and self-exclusion directly in Account Settings. Deposit limits, wager limits and additional cooling-off support remain available via [email protected]. While a self-exclusion or cooling-off is in force we will take reasonable steps to prevent you opening a new Account or betting, but you remain responsible for your own conduct. Never gamble more than you can afford to lose or to chase losses. 18+ only, and only where local law permits.

17. Suspension, Closure and Forfeiture

You may close your Account at any time via [email protected]; we will return any available, legitimately won Balance subject to KYC and these Terms. We may suspend, restrict, close or terminate your Account and access, void Bets, and withhold, forfeit or reclaim funds and Winnings at our sole and absolute discretion where we reasonably believe you have breached these Terms or engaged in prohibited conduct, where required by law or our licence, or to protect the Platform, us or other users. Closure does not affect rights or obligations accrued before it, or any provision intended to survive termination.

18. Dormant Accounts

An Account with no login or wagering activity for 12 continuous months may be treated as dormant. We may notify you at your registered email and, where permitted, apply a reasonable administrative dormancy fee to a dormant Account with a positive Balance. We will make reasonable efforts to return any remaining verified Balance before closing an Account for prolonged inactivity.

19. Intellectual Property and Data

All content on the Platform, including the havocwin.com name and marks, software, games, text, graphics, audio, design and code, is owned by or licensed to us and protected by law. We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose only. You may not copy, distribute, modify, reverse engineer or create derivative works from any part of it. We own all data generated by your use of the Platform and may use it as described in our Privacy Policy.

20. Disclaimers

To the maximum extent permitted by law, the Platform, its games and all content are provided "as is" and "as available", with no warranties, conditions or representations of any kind, express or implied, including as to availability, uninterrupted or error-free operation, accuracy, or fitness for purpose. We do not warrant that any game or feature will meet your expectations. You use the Platform, and you gamble, entirely at your own risk, and you accept the risk of losing the funds you stake.

21. Limitation of Liability

To the maximum extent permitted by law:

  1. we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any loss of profit, revenue, data, goodwill or opportunity, however arising;
  2. we are not liable for any loss arising from cryptocurrency price movement, blockchain or network delay, congestion or failure, wallet or third-party error, force majeure, or any act or omission of a third party;
  3. our total aggregate liability to you for any and all claims connected with the Platform is limited to the lesser of (a) the amount then standing to your Balance and (b) the net amount you deposited in the 30 days before the event giving rise to the claim; and
  4. nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud.

22. Indemnity

You agree to indemnify and hold harmless Havoc Win, its affiliates and their officers, directors, employees and agents from and against all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your use or misuse of the Platform, or your violation of any law or third-party right.

23. Complaints, Disputes and Governing Law

Raise any complaint first with us at [email protected], with full details; we will work with you in good faith to resolve it, and unresolved complaints may be escalated to the Anjouan licensing authority. Where a game outcome is disputed, Provably Fair verification and our records are the primary and decisive evidence.

These Terms, and any dispute arising out of or in connection with them (including non-contractual disputes), are governed by the laws of the Autonomous Island of Anjouan, Union of the Comoros, whose courts and licensing authority have jurisdiction, subject to any mandatory rights you have under the law of your country of residence. Any dispute will be resolved on an individual basis only; to the extent permitted by law you waive any right to bring or participate in any class, collective or representative action. Any claim you may have must be brought within six (6) months of the event giving rise to it, failing which it is permanently barred.

24. Changes, Availability and General

We may amend these Terms at any time, effective when posted on the Platform, and (where permitted by law) with retroactive effect. Your continued use after a change constitutes acceptance; if you do not agree, stop using the Platform and close your Account. We may modify, suspend, restrict or discontinue the Platform, any game or any feature at any time, with or without notice, without liability.

  1. These Terms and the documents incorporated by reference are the entire agreement between you and us regarding the Platform.
  2. If any provision is invalid or unenforceable, the rest continues in force and the provision is applied to the maximum extent permitted.
  3. Our failure to enforce a provision is not a waiver of it.
  4. You may not assign or transfer your rights; we may assign ours, including to a successor operator, without your consent.
  5. We may set off any amount you owe us against your Balance.
  6. We are not liable for any delay or failure caused by events beyond our reasonable control.
  7. These Terms are drafted in English; any translation is for convenience only and the English version prevails.
